NOTICE OF ADOPTION AND ABSTRACT OF LOCAL LAW NO. 9 OF 2021

NOTICE OF ADOPTION AND ABSTRACT OF LOCAL LAW NO. 9 OF 2021.  PLEASE TAKE NOTICE that on the 18th day of October, 2021, the Town Board of the Town of Grand Island adopted Local Law no. 9 of 2021 entitled “Town of Grand Island Solar Law,” amending Town Code §407-165.  The same was accepted for filing by the New York State Department of State on October 20, 2021.  The purpose of the solar law is to advance and protect the public health, safety and welfare of the Town of Grand Island by creating comprehensive regulations for the installation and use of solar energy generating systems and equipment, with the following objectives: 1.To promote the accommodation of appropriately sited solar energy systems and equipment; 2.To maintain the unique island character of the Town of Grand Island; 3.To preserve Grand Island’s natural resources including open space containing parks, wetlands, wildlife management areas, woodlots, and shoreline;4.To recognize the importance of environmental sustainability; 5.To encourage renewable energy systems at an appropriate scale and density to decrease local utility loads and minimize carbon emissions; 6.To mitigate the impacts of solar energy systems on environmental resources such as important agricultural lands, forests, waterbodies, wildlife and other protected resources; and 7. To minimize to the extent practicable the potential impact on members of the community when solar collectors may be installed near their property, while preserving the rights of property owners to install appropriately sited solar energy systems. NOTICE IS HEREBY GIVEN that the preliminary budget of the Town of Grand Island, New York for the fiscal year beginning January 1, 2022 including general town funds, highway funds, fire protection district funds, and light district funds, has been completed and filed in the office of the Town Clerk of the Town of Grand Island, at 2255 Baseline Road, Grand Island, New York 14072, where it is available for inspection by any interested person during office hours.

The Town Board of the Town of Grand Island shall hold a public hearing on said preliminary budget on Monday, November 1, 2021 at 8:00 p.m., showing such changes, alterations and revisions that have been made by the Town Board of the Town of Grand Island.  At such hearing, any person may be heard in favor of or against the preliminary budget as compiled or for or against any item or items therein contained.

NOTICE OF  BOND RESOLUTION

TOWN OF GRAND ISLAND
NOTICE IS HEREBY GIVEN that an amending and restating bond resolution, a summary of which is published herewith, has been adopted by the Town Board of the Town of Grand Island, County of Erie, on October 18, 2021 and the validity of the obligations authorized by such resolution may be hereafter contested only if:

(1)        (a)          such obligations were authorized for an object or purpose for which the Town of Grand Island is not authorized to expend money or

                        (b)          the provisions of law which should have been complied with as of the date of publication of this notice were not substantially complied with
                            and an action, suit or proceeding contesting such validity is commenced within 20 days after the date of publication of this notice; or
(2)        such obligations were authorized in violation of the provisions of the Constitution of New York.

SUMMARY OF BOND RESOLUTION

The following is a summary of an amending and restating bond resolution adopted by the Town Board of the Town of Grand Island on October 18, 2021, that amends and restates a prior bond resolution dated July 20, 2020 (the “Original Bond Resolution”).  The proceeds from the sale of the obligations authorized in said bond resolution (as amended and restated) shall be used to finance a capital improvements project within the District, such work to generally consist of improvements to the wastewater treatment plant including, but not limited to, the installation of sludge dewatering equipment and associated piping and valves, electrical and HVAC improvements, ventilation improvements to the Main Control Building and SCADA/control system upgrades, as well as other such improvements as more fully identified in (or contemplated by) such map, plan and report prepared in connection with such project, all of the forgoing to include all necessary site work, equipment, apparatus and other improvements and costs incidental thereto and in connection with the financing thereof (collectively, the “Project”), at an estimated maximum amount of $2,000,000.  Such amended and restated bond resolution authorizes the issuance and sale of a serial bond or bonds and a bond anticipation note or notes in anticipation of the issuance and sale of such serial bonds, in an aggregate principal amount not to exceed $2,000,000, said amount to be offset by any federal, state, county and/or local funds received.  The amending and restating bond resolution authorizes: (a) an increase in the estimated maximum amount from $1,500,000 to $2,000,000 and (b) an increase in the aggregate principal amount of bonds from $1,500,000 to $2,000,000 and other modifications to the Original Bond Resolution as may be consistent with law.  Such increase in costs for the Project is due to higher than expected bids being received.  The scope of the improvements has not materially changed from the project identified in the Original Bond Resolution.  The period of probable usefulness for such purpose is 40 years.  A copy of the resolution summarized herein is available for public inspection during normal business hours

                                            PUBLIC HEARING TO BE HELD ON NOVEMBER 1, 2021

 

                        WHEREAS, the Town Board of the Town of Grand Island (herein called “Town Board” and “Town”, respectively), in the County of Erie, New York, has, pursuant to Town Law, created the Town of Grand Island Consolidated Water District (the “District”); and

                        WHEREAS, the Town Board has directed the Town of Grand Island Engineering Department, competent engineers licensed in New York, to prepare a preliminary map, plan and report for a water system capital improvements project within the District; and

                        WHEREAS, such water system capital improvements project will generally consist of the rehabilitation of the Water Department Maintenance Garage, such improvements to include, but not be limited to, the removal and replacement of exterior metal cladding and wall insulation system, installation of new ceiling insulation, installation of new bay lift doors and man doors, installation of downspouts and gutters, and the application of an environmental coating system on the existing roof, as well as other such improvements as more fully identified in (or contemplated by) such map, plan and report referred to above, all of the forgoing to include all necessary site work, equipment, apparatus and other improvements and costs incidental thereto and in connection with the financing thereof (collectively, the “District Improvement”); and

                        WHEREAS, pursuant to the direction of the Town, the Engineer has completed and filed with the Town Board such preliminary map, plan and report for such increase and improvement of facilities of the District and has estimated the total cost thereof to be an estimated maximum amount of $550,000; said cost to be financed by the issuance of serial bonds state, county and/or local funds received.

                        NOW, THEREFORE, BE IT ORDERED that a meeting of the Town Board of the Town of Grand Island will be held at the Town Hall, 2255 Baseline Road, Grand Island, New York, on November 1, 2021 at 8:00p.m. o’clock p.m. (prevailing Time) or shortly thereafter to consider said increase and improvement of facilities of the District and to hear all persons interested in the subject thereof concerning the same and for such other action on the part of the Town Board with relation thereto as may be required by law; and be it

FURTHER ORDERED, that the expense of said increase and improvement of the facilities shall be financed by the issuance of serial bonds of the Town in an aggregate principal amount not to exceed $550,000, said amount to be offset by any federal, state, county and/or local funds received, and, unless paid from other sources or charges, the costs of said increase and improvement of facilities shall be paid by the assessment, levy and collection of special assessments from the several lots and parcels of land within the District, which the Town Board shall determine and specify to be especially benefited thereby, so much upon and from each as shall be in just proportion to the amount of benefit conferred upon the same, to pay the principal of and interest on said bonds as the same shall become due and payable, except as provided by law; and be it

FURTHER ORDERED, that the Town Clerk publish at least once in each newspaper designated as the official newspaper of the Town for such publication, and post on the sign board of the Town maintained pursuant to subdivision 6 of Section 30 of the Town Law, a copy of this Order, certified by said Town Clerk, the first publication thereof and said posting to be not less than ten nor more than 20 days before the date of such public hearing.

NOTICE TO THE CITIZENS OF
THE TOWN OF GRAND ISLAND  

            A public hearing will be held on October 18, 2021, at 8:00 p.m. in the Town Hall, regarding the use of Federal Community Development funds in the Town of Grand Island.

            The Town of Grand Island is eligible for a Federal Community Development Grant under Title I of the Housing and Community Development Act of 1974, as amended.

            The purpose of the hearing is to provide an opportunity for citizens to express community development and housing needs and to discuss possible projects that would benefit low-and moderate-income persons in the Town of Grand Island.

            Citizens are urged to attend this meeting to make known their views and/or written proposals on the Town of Grand Island’s selection of potential projects to be submitted for possible funding by the Federal Community Development Grant Program.

            The hearing will also present a review of prior community development projects and expenditures and a discussion of eligible activities. The meeting room is wheelchair accessible.                         WHEREAS, the Town Board of the Town of Grand Island (herein called “Town Board” and “Town”, respectively), in the County of Erie, New York, has, pursuant to Town Law, created the Town of Grand Island Consolidated Sewer District (the “District”); and

                        WHEREAS, the Town Board directed GHD, competent engineers licensed in New York, to prepare a map, plan and report for a sewer system capital improvements project within the District; and

                        WHEREAS, in July of 2020, the Town approved, through Town Law Section 202-b proceedings and a bond resolution (dated July 20, 2020), a certain capital improvements project in the District; and

                        WHEREAS, the cost of such project has increased from $1,500,000 to $2,000,000 due to higher than expected bids being received for the project; and

                        WHEREAS, the Town Board has directed GHD, competent engineers licensed in New York, to prepare a revised map, plan and report to reflect the revised cost of the project; and

                        WHEREAS, such revised map, plan and report amends a certain prior map, plan and report (dated June 2020) for the purposes of (a) increasing the estimated maximum cost of the project and (b) increasing the amount of bonds (and notes) for the project; and

                        WHEREAS, the scope of the improvements has not materially changed from the project identified in such original map, plan and report; and

NOTICE OF PUBLIC HEARING ON DRAFT SCOPING DOCUMENT FOR THE PROPOSED 2780 LONG ROAD DISTRIBUTION FACILITY

 LEGAL NOTICE IS HEREBY GIVEN that the Town Board of the Town of Grand Island will hold a public hearing at 8:00 PM on Monday, October 4, 2021 at Town Hall 2255 Baseline Road, Grand Island, New York 14072 for the purposes of receiving public input on the Draft Scoping Document for the proposed 2780 Long Road Distribution Facility pursuant to the State Environmental Quality Review Act. Copies of the Draft Scoping Document and related project documents can be reviewed at the Town Hall and on the Town’s website at: www.grandislandny.us

At the time and place stated above, all interested members of the public shall be heard.

LEGAL NOTICE IS HEREBY GIVEN that the Town Board of the Town of Grand Island will hold a public hearing at 8:00 PM on October 4, 2021, at Town Hall, 2255 Baseline Road, Grand Island, New York for the purposes of considering and possibly adopting a Local Law amending Chapter 407 of the Town of Grand Island Code, Solar Law Amendments.
